Same Sex Marriage Debate In India


#lgbtqia #samesex #samesexmarriage  Many based on the social media will develop a perception the the order today has gone against the LGBTQIA++ in India.

Ideally there is no judgement or order since, of the 5 judges only 4 opined.

The court has extensively directed the competent authority, in this case the government to revise policies in such a manner that equality and freedom are both established in practice for the LGBTQIA++

Yes they have denied registration of marriage, but they have called for similar rights as those for live in couples. Many heterosexual marriages in India are not registered and yet, they get benefits out of them. The court has asked for similar provisions to be made for LGBTQIA++ couples too.

They have conferred more clear directions for the trans community, which is yet another step forward.

Sticking to the rule book - the court does not make or frame laws, but the highest court only interprets the existing laws. Amendments to existing laws or framing new laws is the job of the government and so it has returned the subject back to the government with a clear outline that, the framework needs to be decided.

Only sad part is, it has not set a deadline for the same; but there is more and more in favor of the LGBTQIA++ than against. Registration of the relationship is just one aspect of it. They have also allowed relationships to take shape in whatever form LGBTQIA++ want them to take shape. 

So You can get married. 

So You can marry by customs.

So give them directives You should be able to nominate your partner for things like bank accounts etc.

ONLY THING YOU CANNOT SAY YOU ARE LEGALLY MARRIED; BUT THEN HOW MANY PEOPLE WHO GET MARRIED GET THEIRS REGISTERED TO SAY THEY ARE LEGALLY MARRIED?????
